Philosophy: Defense in Depth

No single control prevents all data loss. Effective data protection layers multiple controls so that the failure of any one layer is caught by the next. The goal is not to make data breaches impossible — it is to make them difficult, detectable, and limited in impact when they occur.

The best data protection programs are proportional to the risk. Protecting publicly available marketing content with the same rigor as customer payment data is wasteful. Protecting customer payment data with the same casualness as marketing content is negligent. Classification drives proportionality.

Data Classification

Why Classification Comes First

You cannot protect data appropriately if you do not know what it is, where it is, or how sensitive it is. Classification is the foundation that every other data protection control depends on.

Implementing Classification

  1. Define the levels — Four levels is the sweet spot. Fewer is too coarse; more creates confusion.
  2. Assign default classifications — All data is at least "Internal" unless explicitly classified otherwise. This prevents the "everything is unclassified" problem.
  3. Classify at creation — The person who creates or collects the data assigns the initial classification.
  4. Label the data — Apply classification labels to documents, databases, storage locations, and data flows. Automated tools (Microsoft Purview, Google DLP, AWS Macie) can assist.
  5. Map controls to levels — Each classification level has a defined set of required controls (see table below).
  6. Review periodically — Reclassify data when its sensitivity changes (e.g., after a product launch, previously confidential product details may become public).

Encryption

Encryption at Rest

Database encryption:

  • Transparent Data Encryption (TDE) for relational databases — encrypts the data files, log files, and backups without application changes
  • Application-level encryption for specific sensitive fields — encrypts data before it reaches the database; provides stronger protection but requires application code changes
  • Key management — use a dedicated key management service (AWS KMS, Azure Key Vault, GCP Cloud KMS, HashiCorp Vault); never store encryption keys alongside encrypted data

File and object storage:

  • Server-side encryption (SSE) — enabled by default in most cloud providers (S3, Azure Blob, GCS)
  • Client-side encryption — encrypt before upload for maximum control; you manage the keys
  • Use AES-256 for symmetric encryption

Full disk encryption:

  • BitLocker (Windows), FileVault (macOS), LUKS (Linux) for endpoint devices
  • Mandatory for all company-issued laptops and mobile devices
  • Enable remote wipe capability for lost/stolen devices

Encryption in Transit

  • TLS 1.2 or higher for all network communications — disable TLS 1.0 and 1.1

Key Management Principles

  • Separate key management from data storage — compromise of the data store should not reveal the keys
  • Rotate keys regularly — annually for data-at-rest keys, more frequently for session keys
  • Maintain key access logs — who accessed which keys and when
  • Define key recovery procedures — what happens if a key is lost or corrupted
  • Use hardware security modules (HSMs) for the most sensitive keys (master keys, certificate signing keys)
  • Never hardcode encryption keys in source code or configuration files

Access Controls

Principle of Least Privilege

Every user, service, and system should have the minimum access necessary to perform its function. Nothing more.

Access Control Implementation

Identity management:

Physical Access

  • Badge access for offices and data centers
  • Visitor management — escorts in sensitive areas, visitor logs
  • Clean desk policy — sensitive documents secured when unattended

Retention Policies

Designing a Retention Schedule

A retention schedule specifies how long each category of data is kept and what happens when the retention period expires.

Steps:

  1. Inventory data categories — What types of data do you collect and store?
  2. Identify legal requirements — What are the minimum retention periods required by law?
  3. Identify business needs — How long do you actually need the data for business purposes?
  4. Set retention periods — The retention period is the longer of the legal requirement and the legitimate business need
  5. Define disposal methods — How will data be destroyed at the end of the retention period?
  6. Assign data owners — Who is responsible for ensuring compliance with each retention period?
  7. Implement automation — Use automated deletion or archival workflows where possible

Retention Policy Enforcement

  • Automate deletion where possible — do not rely on humans to remember to delete data
  • Implement litigation hold procedures that override normal deletion schedules
  • Audit retention compliance quarterly — are systems actually deleting data on schedule?

Phase 3: Containment

  • Short-term containment — isolate affected systems to stop the spread
  • Evidence preservation — forensic images before remediation

Breach Notification Decision Tree

  1. Was personal data compromised? If no, standard incident handling. If yes, continue.
  2. Was the data encrypted and were the keys NOT compromised? If yes, notification may not be required (safe harbor in many jurisdictions). Document the analysis.
  3. How many individuals were affected? This determines the notification method (individual notice vs. substitute notice for large numbers).
  4. Which jurisdictions are affected? Check notification requirements for each (GDPR: 72 hours to supervisory authority; US: varies by state, typically 30-60 days to individuals).
  5. Is there a risk of harm to individuals? This determines the urgency and scope of notification.
  6. Engage legal counsel to draft notifications and manage regulatory communications.

Vendor Management

Vendor Risk Assessment

Not all vendors pose equal risk. Assess based on:

  • Data access — Does the vendor access, process, or store your data? What classification level?
  • System access — Does the vendor connect to your systems or networks?
  • Business criticality — What is the impact if the vendor is unavailable?
  • Compliance scope — Is the vendor within the scope of your compliance frameworks (SOC 2, HIPAA, PCI)?

Vendor Due Diligence Checklist

  1. Security certifications — SOC 2 Type II, ISO 27001, or equivalent
  2. Data processing agreement — GDPR-compliant DPA with appropriate SCCs for international transfers
  3. Subprocessor disclosure — Who are their subprocessors? Do they notify you of changes?
  4. Incident notification — Contractual commitment to notify you of incidents within a defined timeframe
  5. Data location — Where is your data stored and processed? Does this comply with data residency requirements?
  6. Access controls — How does the vendor control access to your data within their organization?
  7. Encryption — Is data encrypted at rest and in transit within the vendor's environment?

Ongoing Vendor Monitoring

  • Review SOC 2 reports annually — check for qualified opinions or significant findings
  • Monitor vendor security posture — use external monitoring tools (SecurityScorecard, BitSight)
  • Reassess vendor risk when their service scope changes
  • Maintain a vendor inventory with classification, data flows, contract terms, and review dates
  • Conduct periodic audits of critical vendors (or rely on third-party audit reports)

Anti-Patterns: What NOT To Do

  • Do not encrypt everything with the same key. Compromise of one key should not expose all data. Use separate keys for separate data domains, and envelope encryption for scalable key management.
  • Do not create a data classification scheme nobody uses. If classification is too complex or too burdensome, people will default to the lowest level. Make classification easy — integrate it into document creation workflows, default to the appropriate level based on system or data type.
  • Do not write an incident response plan and put it in a drawer. An untested plan is barely better than no plan. Conduct tabletop exercises at least quarterly. Run a full simulation annually. Update the plan after every real incident.
  • Do not grant permanent administrative access. Use just-in-time privilege elevation. Permanent admin accounts are the highest-value target for attackers and the most common vector for insider threats.
  • Do not assume your vendors are secure because they said so. "We take security seriously" in a vendor's marketing is not evidence. Request SOC 2 reports, review them, and follow up on findings.
  • Do not retain data beyond the retention period "just in case." Excess data is excess risk. If you do not need it and are not legally required to keep it, delete it. Every record you keep is a record that can be breached, subpoenaed, or subject to a data subject access request.
  • Do not treat data protection as a purely technical problem. The majority of data breaches involve human factors — phishing, misconfiguration, insider threats, social engineering. Training, awareness, and process design are as important as firewalls and encryption.
  • Do not forget about data in non-production environments. Test and staging environments often contain copies of production data with weaker controls. Mask or anonymize production data before using it in non-production environments.
